2. What oChef.com provides

2.1 oChef.com is a restaurant discovery platform enhanced by modern AI and data analysis. We provide restaurant pages, rankings, and insights based on the evaluation of publicly available information, including customer reviews from third-party platforms.
2.2 The Services are provided for informational purposes only. We do not operate restaurants, and we do not guarantee any specific dining experience.

3. Data sources, scores, and recommendations

3.1 We may collect and analyze publicly accessible reviews and related information from third-party sources (for example Google Maps, Tripadvisor, Yelp, and other sources depending on availability and region).
3.2 We use automated methods, including AI-based analysis, to generate category scores (for example Food, Service, Atmosphere, Value for Money) and an overall Recommendation Score.
3.3 Scores reflect aggregated patterns found in available data and are not a statement of fact about any single visit. Individual experiences may vary.
3.4 Scores and listings may change over time as new information becomes available, sources change, or our methods are updated.

4. No guarantee of accuracy or completeness

4.1 We compile information with care, but we do not guarantee that content is accurate, complete, error-free, or up to date at all times.
4.2 We may display third-party information that is outside our control (for example opening hours, menus, prices, addresses, photos, or review snippets). Such information may be outdated or incorrect.
4.3 You are responsible for verifying important details directly with the restaurant (for example reservations, allergens, pricing, or availability).

5. Availability of the Services

5.1 We aim to keep the Services available without interruptions, but continuous availability cannot be guaranteed.
5.2 Maintenance, technical issues, or external factors may temporarily limit access. We are not liable for downtime except where required by applicable law.

6. Paid promotions and business features

6.1 oChef may offer paid promotion services or business-facing tools for restaurateurs.
6.2 If you use such services, additional terms may apply and will be presented during registration or purchase.

7. Intellectual property

7.1 The Services, including text, graphics, logos, design, databases, and software (collectively, “oChef Content”), are protected by intellectual property laws.
7.2 oChef grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
7.3 Except as expressly permitted, you may not copy, reproduce, distribute, sell, lease, publicly display, or create derivative works from oChef Content.

8. Acceptable use and restrictions

You agree not to, and not to help others to:
8.1 Access, scrape, harvest, copy, or monitor any portion of the Services using automated means (for example bots, spiders, scrapers) without our prior written permission.
8.2 Circumvent any access controls, security measures, rate limits, or technical protections.
8.3 Reverse engineer, decompile, disassemble, or attempt to extract source code or non-public APIs, except to the extent permitted by applicable law.
8.4 Interfere with or disrupt the Services, servers, or networks.
8.5 Use the Services for unlawful purposes or in a way that violates third-party rights.

9.2 Your interactions with third parties (including restaurants) are solely between you and the third party. Restaurants are responsible for their services, offers, and policies.

10. Termination

10.1 You may stop using the Services at any time.
10.2 We may suspend or terminate your access to the Services immediately if we believe you violated these Terms, if required by law, or to protect the Services, users, or third parties.
10.3 Upon termination, your right to use the Services ends. Some provisions of these Terms will continue to apply by their nature (for example intellectual property, disclaimers, liability limitations, and dispute provisions).

11. Liability limitations

11.1 To the maximum extent permitted by applicable law, oChef is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to your use of (or inability to use) the Services.
11.2 To the maximum extent permitted by applicable law, oChef is not liable for issues arising from your visit to a restaurant or your interactions with restaurants or other third parties.
11.3 Nothing in these Terms limits liability where such limitation is prohibited by law (for example liability for intent, gross negligence, or injury to life, body, or health, where applicable).

12. Disclaimer of warranties

12.1 The Services and all content are provided on an “as is” and “as available” basis.
12.2 To the maximum extent permitted by applicable law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.3 We do not guarantee that the Services will be uninterrupted, secure, or error-free.

13. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless oChef from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms.


14. Copyright complaints (DMCA)

14.1 How to submit a DMCA notice

If you believe content on oChef.com infringes your copyright, you may submit a notice requesting removal. Your notice should include:

a) Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works are involved).
b) Identification of the material you claim is infringing, and enough information to help us locate it (for example a URL on oChef.com).
c) Your contact information (email address is required).
d) A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
e) A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
f) Your electronic or physical signature.

We may request additional information before acting on your notice.

14.3 Counter-notification

If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification should include:

b) A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
c) Your name and email address.
d) A statement that you consent to the jurisdiction of the appropriate court as required by applicable law.
e) Your electronic or physical signature.

We will handle counter-notifications in accordance with applicable law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be interpreted or replaced to reflect the original intent as closely as permitted by law.

16. Assignment
